1. Who we are

Hilniva Inc. ("Hilniva", "we", "us") is a software company headquartered at 3130 De La Cruz Blvd, Ste 128, Santa Clara, CA 95054, USA. We make Hilniva ERP, Hilniva Payable, Hilniva Receivable, Hilniva SpacePulse and Hilniva BI.

2. Scope

This policy covers personal information we collect through our website, hilniva.com, and when you contact us, request a demo or download a datasheet. It does not cover data that our customers put into Hilniva products. That data is processed on our customers' behalf under their subscription agreements with us, and the customer controls it.

3. Information we collect

Information you give us. When you fill in a form on our site, we collect what you enter, which may include your name, work email, company, job title, phone number, country, company size, the products you're interested in, your message, and your contact and marketing preferences.

Information collected automatically with a form. When you submit a form, we record the page you submitted it from, the referring page, any campaign tags in the link (such as utm_source), the date and time, your IP address and your browser's user-agent string. We use this to prevent abuse and to understand which pages and campaigns bring enquiries. When you download a datasheet using the link we send you, we record that the download happened.

Server logs. Our hosting provider keeps standard access logs (IP address, requested page, date and time, browser type) for security and operations.

4. How we use it

• To respond to your request, schedule demos and send the datasheets you asked for.
• To follow up about the products you showed interest in, as part of our sales process.
• To send occasional product news, only if you opted in. You can opt out at any time.
• To keep our website and forms secure and prevent spam and abuse.
• To understand how people find us and improve our website.

We record your enquiry in our sales systems, including our customer relationship management (CRM) system, so our team has the context when they talk to you.

5. Who we share it with

We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We share it only with:

• Service providers that host and run our website, forms and email on our behalf (for example, Amazon Web Services), under contracts that limit their use of the data.
• Professional advisers and authorities where required by law or to protect our rights.
• A successor business if Hilniva is involved in a merger, acquisition or sale of assets, subject to this policy.

6. Cookies and tracking

Our website does not use advertising cookies or third-party tracking scripts. Your browser may store small preferences locally to make the site work. If we add analytics in the future, we will update this policy first.

7. How long we keep it

We keep enquiry and lead information for as long as it's useful for the relationship, and review inactive records at least every 24 months. If you ask us to delete your information, we will, unless we need to keep it to meet a legal obligation.

8. Security

We protect personal information with access controls, encryption in transit and at rest, and logging, and we limit access to people who need it for their work. No system is perfectly secure, but we work to protect your information and will notify you if required by law.

9. Where it is stored

Website and lead information is stored with Amazon Web Services in the United States. If you are outside the United States, your information will be transferred to and processed in the United States.

10. Your rights

Depending on where you live, you may have the right to:

• know what personal information we hold about you and get a copy;
• correct or update it;
• ask us to delete it;
• withdraw consent or opt out of marketing at any time;
• not be treated differently for exercising these rights.

California residents. Under the California Consumer Privacy Act, as amended by the CPRA, you have the rights above. We do not sell or share personal information, and we do not use sensitive personal information for purposes that require an opt-out. You may use an authorized agent to make a request.

India. Under the Digital Personal Data Protection Act, 2023, you may access, correct and erase your personal data, withdraw consent, nominate another person to exercise your rights, and raise a grievance with us. If we don't resolve your grievance, you may approach the Data Protection Board of India.

To make a request, email sales@hilniva.com with the subject "Privacy request". We will verify your identity before acting on it and respond within the time required by law.

11. Children

Our website and products are for businesses. We do not knowingly collect personal information from children. If you believe a child has given us information, please contact us and we will delete it.

12. Changes

We may update this policy. When we do, we'll change the "last updated" date above, and for significant changes we'll make that clear on this page.
